Secuestro como conducta típica generadora de violación al marco de DDHH: estudio de las consecuencias generadas por las insurgencias entre 1990 y 2023 en territorio colombiano.

Abstract

El objetivo general de esta investigación es analizar la fenomenología del secuestro como conducta típica generadora de violación al marco de derechos humanos (DDHH) por parte de las insurgencias colombianas entre 1990 y 2023, tomando como objeto de estudio el concepto de protección pública socio humanística. A través de un enfoque cualitativo, la investigación busca describir el secuestro desde la tipificación de la CIDH, explorar su caracterización cualitativa en el territorio colombiano, y explicar la problemática mediante el concepto de protección pública socio humanística. Se propone una metodología de análisis cualitativo a partir de estadísticas tomadas del CEMEHIS de documentos y testimonios, con el fin de ofrecer recomendaciones estratégicas para mejorar la protección de derechos humanos y prevenir futuros secuestros.

The general objective of this research is to analyze the phenomenology of kidnapping as a typical conduct generating human rights (HR) violations by Colombian insurgencies between 1990 and 2023, using the concept of socio-humanistic public protection as the study object. Through a mixed-methods approach, the research aims to describe kidnapping according to the Inter-American Commission on Human Rights (IACHR) classification, explore its quantitative characterization in southeastern Antioquia, and explain the issue using the socio-humanistic public protection concept. An exhaustive methodology is proposed, including quantitative analysis of statistical data and qualitative analysis of documents and testimonies, to provide strategic recommendations for enhancing human rights protection and preventing future kidnappings.
